Terms of Service

1. Acceptance of Terms

By accessing or using Kiuei ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kiuei is a cloud-based test management platform that allows teams to organize, execute, and track software testing activities. The Service is provided on a subscription basis with different plan tiers.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Free Trial

New accounts receive a 14-day free trial with access to core features. No credit card is required to start the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

5. Subscription and Payment

• Paid plans are billed monthly or annually, depending on the plan selected.
• Payments are processed through our third-party payment provider (Stripe).
• You authorize us to charge your payment method on a recurring basis.
• Plan upgrades take effect immediately; downgrades take effect at the next billing cycle.
• All fees are non-refundable except as required by law.

6. Plan Limits

Each plan has resource limits (users, projects, test cases). If you exceed your plan limits, you will need to upgrade to continue creating new resources.

7. Data Ownership

You retain all rights to the data you upload to the Service. We do not claim ownership of your content. Upon account deletion, your data will be permanently removed within 30 days.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service or its systems.
• Interfere with or disrupt the Service.
• Share your account credentials with unauthorized parties.
• Use the Service to store or transmit malicious code.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.

10. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. After that, your account will be downgraded and data may be subject to deletion after 90 days of inactivity.

11. Limitation of Liability

To the maximum extent permitted by law, Kiuei shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the courts of the jurisdiction where the company is registered.
